Under a pure comparative liability system, a plaintiff may still recover damages even if they are up to 99% at fault in their own injuries. If the plaintiff is judged to bear a portion of the fault for an injury, any damages determined will be reduced proportionate to the percentage of fault. In other words, if a plaintiff is determined to be 90% at fault for his or her own injuries in an asbestos lawsuit and the jury determines that damages in the case amount to $100,000, the plaintiff can still recover $10,000 in damages.

The Louisiana courts follow a modified joint and several liability approach in apportioning awards in cases that involve more than one defendant. In most cases, several liability applies. Under several liability, the jury or judge determines the percentage of fault carried by each defendant, and the defendant's responsibility for any damages is proportionate to their share of the fault. Under several liability, the defendants with the greatest responsibility for the damage pays the greatest share of the compensation. However, when two or more defendants are found to have conspired to commit an intentional act, joint liability applies. In that case, each of the defendants is jointly liable for the entire award.

2007 - Graves v. Riverwood Intern: The Louisiana Appellate Court upheld a jury verdict in favor of a West Monroe paper mill worker. In the same case, the court held referenced other Louisiana cases that give plaintiffs who were substantially exposed to asbestos before 1975 the right to sue the companies that employed them because asbestos-related diseases were not compensable under Louisiana workers compensation laws until 1975. Under that law, Olin Corp, a perennial defendant in asbestos related cases, was not allowed to escape liability for their negligence in exposing the plaintiff to asbestos.

2005 - Watts v. Hebert Brothers Engineers: A Louisiana jury awarded $3.625 million to the family of a man who worked for the engineering company from 1963 to 1994, and died of asbestos-related lung cancer in 2001.

2003 - Rando v. Jacob Constructors et al: A East Baton Rouge jury awarded as $3.2 million verdict to a 61 year old pipefitter who developed mesothelioma after years of working with materials containing asbestos. Among the other defendants of the suit were Shell Oil, Teneco and Murray Oil.

The shuttle landed at 225 mph at the Kennedy Space Center in Florida at 11:57 this morning, capping off 5,830 spins around the planet and spending a total of exactly a year in outer space, which will go into the books as a record.

Discovery is the oldest of NASA's space shuttles and has flown a record 148 million miles to complete research and International Space Station missions.


The final mission began on Feb. 24, although it had originally been scheduled for Nov. 1. Due to poor weather and mechanical problems, it was delayed. The purpose of this mission was to supply the International Space Station with food and various other supplies and equipment.

Now that it's entered the sunset of it's life, Discovery will most likely end up on display at the Smithsonian, but first it will undergo several months of post-flight maintenance at NASA. A team will pull out anything that could pose a health hazard, like fuel tanks, plumbing and thermal blankets that have absorbed toxic fumes over the years. Engines will be replaced with replicas and spare parts. The announcement about its destiny will be made on April 12, which is the 30th anniversary of the shuttle fleet's first spaceflight. The open secret is that it will wind up at Udvar-Hazy Center, an annex of the Smithsonian's National Air and Space Museum in Virginia.

The Shuttle Endeavor is scheduled to blastoff on April 19th (with Rep. Gabrielle Giffords' husband, Mark Kelly on board). The Shuttle Atlantis is then supposed to take off on June 28th, which will mark the final journey for the shuttle program.

"Ron Schiller has informed us that, in light of the controversy surrounding his recent statements, he does not feel that it's in the best interests of the Aspen Institute for him to come work here," Aspen Institute spokesman Jim Spiegelman said in an email to TheDC.

The Aspen Institute has also removed from its website a press release from March 3 announcing Schiller's hiring. The press release quoted Aspen Institute President and Chief Executive Walter Isaacson as having the same views as Schiller.

"Ron Schiller embraces and lives the values that we share as a community," said Isaacson in that release, which can still be seen at Yahoo! News. "I am very pleased that he has agreed to join us to help us build a strong and vibrant arts program, the kind of program that we believe is central to the institute's origins and to its mission."

NPR dismissed Schiller and his boss, NPR Chief Executive Vivian Schiller (no relation), over the past two days in light of a sting video conservative James O'Keefe released Tuesday showing Schiller and another NPR executive, Betsy Liley, making disparaging remarks about the Tea Party movement, saying Jewish people "obviously" control America's newspapers and for saying NPR would survive and be "better off" in the long run without federal funding.

People ages 14 and older are expected to engage in the abstinence of meat on all Lenten Fridays, as well as on Good Friday and Ash Wednesday. There are exceptions regarding what falls into the meat category, though. Dairy products, eggs and various forms of animal fat are OK. Therefore, it is OK to eat margarine, broth and gravy on days of abstinence; it is simply necessary to avoid meat. Today, Catholics around the world are engaging in abstinence and fasting in order to meet the obligation of penance that is required by their church.

The Overblown Square Credit Card Reader Security DisasterOcimnet.com - Square's credit card reader for iOS/Android devices is pretty awesome—it lets anybody quickly and easily start taking credit payments. But according to Douglass Bergeron, the CEO of competing company Verifone, the device itself isn't hardware-encrypted, meaning anyone could write an app that strips unprotected info from your card.

Verifone's smear campaign is impressive, to say the least. They've launched a site dedicated to attacking Square and released, for anyone to download, a demo version of a Square skimming app their own engineers developed. (Without the skimming abilities actually built in.) They're also sending everything to all of the major credit companies, like Visa, Mastercard and others. Somehow Verifone fails to mention though they've got their own competing product in the mobile payments space.

Here's the reality: In order for your card to get "skimmed" by a fake Square reader, you'd have to hand over your card to the fraudster in the first place to allow it to be scanned. Would you really hand over your credit card to somebody you didn't trust (at least enough to pay them for goods or services) in the first place? And if that vendor is scamming you, how is it so different from a situation where, you hand a credit card over to a waiter in a restaurant and they secretly skim it in the back? As to making potential skimming devices widely available, there's this other thing that does that called the internet.

Bergeron thinks Square should recall all their readers until they find a way to secure the device. Square should definitely do everything it can to make the devices as secure as possible (encryption is never a bad thing), but you can probably keep swiping at places you trust without freaking out for now, despite Verifone's best efforts to make that happen. Vivian Schiller bows out at NPR after rightwing sting brings embarrassmentOcimnet.com - The chief executive of America's National Public Radio (NPR) network has quit her post after a video sting by rightwing activists posing as campaigners for a fictitious Muslim group.

Vivian Schiller resigned as NPR chief executive a day after the release of a video of a lunch at a fashionable Georgetown restaurant in which fundraisers for the network and the imposters discussed racist tendencies in the Tea Party, as well as the anti-intellectual streak in Republicans, Jewish media "conspiracy", and a potential $5m donation to public broadcasting.

The undercover operation was engineered by the conservative activist James O'Keefe, who made his name with a previous undercover sting against Acorn, a community organisation much reviled by the right in the US.

The senior NPR fundraiser in the video, Ron Schiller, who is no relation to the former chief executive, had been due to leave the radio network for the Aspen Institute.

But Schiller told reporters on Wednesday he would not be taking that job.

In the 11-minute, heavily edited video, he denounces the Tea Party as scary, seriously racist, and weirdly evangelical. "I mean basically they are, they believe in sort of white, middle-America, gun-toting. I mean, it's scary. They're seriously racist, racist people."

In the video Schiller offers no reaction to the impostors' claims to be a front group for the Muslim Brotherhood and laughs when one of the men jokes that NPR should be known as National Palestinian Radio.

Vivian Schiller immediately condemned his "appalling" comments, and the network made clear that it had never intended to accept the proffered $5m.

But in a conference call with reporters, Dave Edwards, the chairman of the NPR board, said that Schiller had to go. "The CEO of any organisation is accountable for all of the operations of that organisation," he said.

Vivian Schiller's exit is the latest in a string of high-profile and speedy departures from NPR since last autumn.

The episode led to immediate calls from Republicans to cut off funds to public broadcasting, and columnists predicted further turmoil for NPR.

The media commentator Jeff Jarvis said on his blog that Schiller's departure suggested NPR's board was too weak in the face of political pressure. Others suggested that NPR had been too quick to "sack" its chief executive.

The network acknowledged some of the turmoil hitting the organisation. "I recognise the magnitude of this news – and that it comes on top of what has been a traumatic period for NPR and the larger public radio community," Edwards said in a statement.

NPR had yet to fully recover from its clumsy sacking of Juan Williams, a political analyst who did double duty on the rightwing TV network Fox News. Williams, who had been at NPR for 10 years, was sacked for comments made on Fox last October when he said that he felt nervous getting on a plane with people dressed in "Muslim garb".

The sacking, and a network official's snide comments about Williams's mental state, made the commentator a hero to conservatives, who embraced him as a victim of political correctness.

Williams also got a full-time job with Fox. Three months later NPR forced out the news executive who had sacked Williams.

But Williams's dismissal had already inspired O'Keefe, who arranged for two colleagues to pose as activists for a Muslim Brotherhood front group which was offering NPR $5m with no strings attached.

Potential damage to NPR was compounded by the fundraiser's assertions that the network would be better off without federal funds.

In public, however, NPR executives have been fighting hard to stop Republican cuts to public broadcasting.

The exposé of NPR is the second big coup for O'Keefe, although he also has credibility problems. He came to fame in 2009 with a takedown of Acorn, an organisation that had worked for 40 years with poor communities. In 2009, he and a female accomplice visited Acorn offices posing as a pimp and prostitute seeking advice on evading taxes. Acorn disbanded late last year.

But O'Keefe pleaded guilty last year to bugging the telephones of the Louisiana Democratic senator Mary Landrieu, and was sentenced to three years' probation. He was also caught conspiring to lure a CNN reporter to a houseboat for a sex tryst, which he planned to film with hidden cameras.

It has not been confirmed yet that Davidson's character is leaving the show, but in his interview with E! Davidson kept talking about the character in past tense, and he said specifically "there is something very significant that happens with Chase in the course of the season." When pressed for details, he would only say "I guess…how long Chase is around. That's probably all I can really say."

His character has already had marriage problems, so maybe there's a divorce in Chase's future. Or maybe he gets killed. Either way, Davidson doesn't seem too concerned about his paycheck. Must be nice!

David Broder as Washington Post Legend Has DiedOcimnet.com - David S. Broder, the Washington Post political writer who covered presidents, Congress and elections for decades, died Wednesday at 81, the Post reported on its Web site.

For years, Mr. Broder was often thought of as the dean of the Washington press corps. Polite and friendly, he was nonetheless a dogged political reporter who won a Pulitzer Prize for his coverage of Watergate.

Later in his career, he became a columnist for the Post, using his column to skewer politicians he saw as straying from the truth-telling that he valued.

Mr. Broder had suffered from the effects of diabetes for years and had slowed down from his legendary energetic output.

But that change in pace came only recently. Mr. Broder covered the 2008 presidential campaign the way he had covered campaigns decades earlier: on the ground, in New Hampshire, Iowa and around the country.

Mr. Broder especially liked the interaction with voters, and spent much time over the years convening focus groups in early primary states and knocking on doors to gauge the political sentiment of the electorate.

The Post's publisher, Katharine Weymouth, and its editors put out a statement shortly after his death:

"His arrival in 1966, engineered by Ben Bradlee early in Ben's tenure as executive editor, in many ways marked the beginning of the Post's evolution into a great newspaper," the statement said. "In the decades since, David's integrity, fairness, wisdom and curiosity served as a model for us all. But in the newsroom, just as on his dogged reporting trips around the country, David always behaved as though he had more to learn than to teach."

Political reporting in Washington has changed over the years with the advent of the 24-hour cable news channels and, later, the Internet. But Mr. Broder hardly altered his style, making few appearances among the angry talking heads or embracing the Web.

Instead, Mr. Broder stuck to what he knew: writing news stories for the newspaper and his column. In the process, he was sought out by politicians at the highest level who sought favorable mentions by him, and feared those that were not.

At The Washington Post, Mr. Broder approached the status of legend, but he was also a friendly presence. In a statement on Wednesday, his family said that "his reporting colleagues and friends were a deep source of enjoyment for him."

"His greatest admiration and respect were always for the voters themselves, who would answer a knock on their door, let him into their homes, and share their observations on the issues of the day," the family said. "Their passion for this country and its possibilities mirrored his own. To the countless thousands who, since 1953, inspired his curiosity and informed his reporting, we offer our thanks."

"The Google Chrome team is excited to announce the arrival of Chrome 10.0.648.127 to the Stable Channel for Windows, Mac, Linux, and Chrome Frame," reads the announcement.

Jason Kersey, of the Google Chrome team, is proud to make the official introductions, by noting that "Chrome 10 contains some really great improvements including:
  • New version of V8 - Crankshaft - which greatly improves javascript performance
  • New settings pages that open in a tab, rather than a dialog box
  • Improved security with malware reporting and disabling outdated plugins by default
  • Sandboxed Adobe Flash on Windows
  • Password sync as part of Chrome Sync now enabled by default
  • GPU Accelerated Video
  • Background WebApps
  • webNavigation extension API"

Google elaborates on these enhancements in a separate post, where the search giant reveals that this stable release will enable users to rely on even the most complex web apps, as they will run without a hiccup.

"For the curious, this boost corresponds to a 66% improvement in JavaScript performance on the V8 benchmark suite," Google outlines.

A major new addition is Chrome's new settings interface, which helps users get to the right settings quickly by offering suggestions as they type, as well as by providing a link (path) to that exact setting menu.

"No more long, frustrating phone conversations with your dad on where to find that specific setting in the browser," Google's Tim Steele, software engineer, writes.

Chrome now allows users to quickly log on to the websites they use most, even when they switch computers, by synchronizing their passwords.

A safer browsing experience is also advertised by Google in Chrome 10, "as we've extended Chrome's sandboxing technology to the integrated Flash Player in Chrome," says the Mountain View, California search giant.

In a separate announcement, Google unveiled Chrome 11.0.696.0 Dev for Windows, Mac, and Linux.

It brings with it an updated V8 engine (version 3.2.0.1), new "cookies and other data" page in tabbed settings, and a few Mac-specific tweaks, like: turned confirm to quit on by default; tweak the Tab Overview UI; and Cloud Print connector UI enabled.

For Mac OS X, the requirements for using Google Chrome are Mac OS X 10.5 Leopard or later and an Intel-based Mac.

Millions of dead fish blanket Redondo's King Harbor MarinaOcimnet.com - Millions of sardines created a massive stink and an even bigger cleanup effort in Redondo Beach's King Harbor Marina on Tuesday after they swam inside overnight, became trapped and died.

Twelve to 18 inches of dead sardines blanketed the water's bottom in Basin 1 off Marina Way. Another thick layer of dead fish coated the surface from the breakwall to the inner docks, surrounding boats and walkways.

Authorities with the California Department of Fish and Game, along with other ocean biologists at the scene, declared the mass death a natural event. The fish, they said, sucked every drop of oxygen from the water and couldn't breathe.

Hughan said authorities believe the huge school of sardines, perhaps blown in by the night's 40-mph winds and crashing waves, swam into King Harbor and became disoriented.

Those who chose other basins were fine, but the schools that headed into Basin 1 "backed themselves into a corner" and were unable to find their way out, he said.
They quickly depleted the oxygen in the water and died.

"If they turned right instead of left, they'd be fine," Hughan said. "It's just bad luck."

Brent Scheiwe, director of the Los Angeles Conservation Corps' SEA Lab on Harbor Drive, said tests revealed the water contained virtually no oxygen.

"Someone reported it this morning at 7:30. We were astounded when we went down there," he said.

The aquarium received reports that there was a large number of fish in the harbor Monday night, "numbers we had not seen before," Scheiwe said.

He said the spike could have occurred for several reasons - one being rough ocean currents that could have driven the fish to one place.

King Harbor residents said they noticed the increase in fish the night before, swimming among their boats and bouncing off their hulls.

At about 9:30 Monday night, Schultz jumped on deck after hearing a noisy racket. He discovered the entire marina "boiling" around him.

"It was the most I have ever seen," Schultz said.

When the sun came up, residents found the marina's ocean surface coated with dead fish.

Japan Earthquake Today is 7.2 MagnitudeOcimnet.com - An earthquake of 7.2 magnitude has struck off the coast of Japan, shaking buildings in the capital, Tokyo, and triggering a small tsunami.

The tremor was centred 168km (104 miles) from the east coast, north-east of Tokyo.

A 60cm (24in) tsunami reached the coastal town of Ofunato, with other towns reporting smaller waves shortly after the quake hit at 1145 (0245 GMT).

There are so far no reports of damage or injuries.

Japan is well-prepared for quakes which often hit the seismically active area.

An aftershock measuring 6.3 magnitude struck after the main quake, Japan's meteorological agency said, followed by a series of smaller aftershocks.

Some train services in the area were temporarily halted after the quake, but they were restarted shortly after noon.

Tohoku Electric Power said its Onagawa nuclear plant was operating normally after the quake and Tokyo Electric Power also said its power supplies were unaffected.
